Facebook fined €110 million for misleading EU in WhatsApp deal

Facebook has been fined EUR110 million for misleading EU antitrust regulators during its deal to acquire WhatsApp in 2014. Reuters reported[1] that the European Commission said Facebook led it to believe it could not automatically match user accounts on its platform with WhatsApp users. However, two years later, it reworked[2] WhatsApp’s terms of service to do just that.

Facebook said the errors made in its 2014 filings were not intentional, and the Commission had confirmed it had not affected the outcome of the merger review.

The fine will not reverse the Commission’s decision, but acts as a “proportionate and deterrent fine”.
